The four major intellectual property (IP) law areas are patents, copyrights,
trademarks and trade secrets. For most AAPS members, patents would be of greatest
interest. Therefore, this group will emphasize patent issues.
Scientist Invent, Lawyers Patent. The creation of the best possible patents and
their fullest protection requires a high degree of understanding of the inventing
and patenting processes by pharmaceutical scientists and patent attorneys. Failure
of such understanding between these 2 groups can hinder development of long term
and on-going strategies for creation and protection of pharmaceutical patents.
Lack of strategies can be costly to the pharmaceutical industry as shown by recent
loss of patent protection of blockbuster drugs such as Prozac® and Prilosec®
(visit www.lawandscience.com,
Patent Law section for details). Pharmaceutical scientists can play a critical
role in the development of these patent strategies. This IP focus group hopes to
provide an active forum for all AAPS members to learn and educate each other about
patent issues; an electronic listserve is planned for posting of questions and
answers.
This focus group will also help AAPS to broaden the scope of “pharmaceutical
sciences”. Since IP issues are not part of most graduate programs in pharmaceutical
sciences, discussions on the proposed listserve will benefit students. Few science
associations, if any, have a focus group devoted to IP issues. This focus group
could provide additional incentives for patent attorneys, especially those working
in our industry, to become more active members of AAPS. Such membership should
enable the development of innovative programs at the interface of pharmaceutical
sciences and patent law that will be educationally, intellectually and financially
rewarding.
Objectives:
- knowledge of basic concepts of patent law among pharmaceutical scientists
- understanding of the impact of case history on drug discovery and development
- development of strategies to create and protect pharmaceutical patents
- efficiency of scientist-patent attorney interaction
